Welcome to Excuse AI! These Terms of Service ("Terms") govern your access to and use of the Excuse AI mobile application ("App," "Service," or "Application"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Excuse AI, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and WebWiz24 ("we," "us," or "our").

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use Excuse AI. By using the App, you represent and warrant that you meet this age requirement.

2.2 Account Responsibility

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the App, you must create an account using one of the following methods:

  • Google Sign-In
  • Apple Sign-In
  • Email and password registration

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4. Description of Service

4.1 Core Features

Excuse AI is an AI-powered mobile application that generates creative excuses based on user inputs, including:

  • Customizable excuse generation using Google Gemini AI
  • Personalization based on recipient, situation, tone, and communication channel
  • Contact integration for personalized excuse creation
  • Excuse history and favorites management
  • Multi-language support (English, French, Spanish, Dutch)

4.2 Free vs. Pro Features

Free Tier:

  • Limited excuse generation (3 excuses per day)
  • Access to basic tones and situations
  • Ad-supported experience

Pro Subscription:

  • Unlimited excuse generation
  • Access to all premium tones and features
  • Ad-free experience
  • Priority AI processing
  • Advanced customization options
  • "Teach My Tone" feature for personalized writing styles

5. Subscription and Payment Terms

5.1 Pro Subscription

Pro subscriptions are available on a recurring basis (monthly or annual) and are processed through:

  • iOS: Apple App Store (managed by Apple Inc.)
  • Android: Google Play Store (managed by Google LLC)

Subscription management is handled by RevenueCat on our behalf.

5.2 Pricing and Billing

  • Subscription prices are displayed in the App before purchase
  • You will be charged through your Apple App Store or Google Play Store account
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

5.3 Free Trials

We may offer free trial periods for Pro subscriptions. If you do not cancel before the trial period ends, you will be automatically charged for the subscription.

5.4 Cancellation and Refunds

  • You can cancel your subscription at any time through your App Store or Google Play Store account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods
  • Refund requests must be submitted through the App Store or Google Play Store, as we do not process payments directly

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect at the start of your next billing cycle. We will notify you of price changes in advance.

6. User Conduct and Acceptable Use

6.1 Permitted Use

You agree to use Excuse AI only for lawful purposes and in accordance with these Terms. You may use the App for personal, non-commercial purposes.

6.2 Prohibited Activities

You agree NOT to:

  • Use the App for any illegal, harmful, or fraudulent purpose
  • Generate excuses that promote hate speech, violence, discrimination, or harassment
  • Use the App to defame, abuse, harass, stalk, threaten, or otherwise violate the rights of others
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Attempt to gain unauthorized access to the App, other users' accounts, or our systems
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems (bots, scrapers) to access the App
  • Interfere with or disrupt the App's functionality or servers
  • Remove, circumvent, or disable any security features or access controls
  • Upload or transmit viruses, malware, or other malicious code
  • Violate any applicable laws, regulations, or third-party rights

6.3 Content Responsibility

While Excuse AI generates content using AI, you are solely responsible for how you use that content. We do not endorse or take responsibility for the excuses generated or how you choose to use them.

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content, features, functionality, and intellectual property in the App, including but not limited to:

  • Software code and architecture
  • Design, graphics, and user interface
  • Trademarks, logos, and branding
  • Proprietary algorithms and AI integration

are owned by WebWiz24 or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7.3 User-Generated Content

You retain ownership of any content you input into the App (e.g., custom situations, tone preferences). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve the Service.

7.4 AI-Generated Content

Content generated by the AI (excuses) is provided "as-is" for your personal use. We do not claim ownership of AI-generated content, but we are not responsible for its accuracy, appropriateness, or consequences of its use.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • We collect personal information as described in our Privacy Policy
  • We use Firebase for authentication and data storage
  • We use Google AdMob for advertising
  • We use Google Gemini AI for excuse generation
  • Account deletion permanently erases all your personal data

The App integrates with third-party services, including:

  • Google Sign-In / Apple Sign-In: Authentication services

Your use of these services is subject to their respective terms and privacy policies.

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of service of any third-party sites.

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of accuracy, reliability, or completeness of AI-generated content
  • Uninterrupted, secure, or error-free operation

10.2 AI-Generated Content Disclaimer

Excuse AI uses artificial intelligence to generate content. We do not guarantee:

  • The accuracy, appropriateness, or quality of generated excuses
  • That AI-generated content will be suitable for your specific situation
  • That using AI-generated excuses will achieve your desired outcome

You use AI-generated content at your own risk and discretion.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBWIZ24 AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless WebWiz24 and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use of AI-generated content
  • Any content you submit or transmit through the App

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  1. Going to Settings in the App
  2. Selecting "Delete Account"
  3. Confirming your decision

Upon account deletion, all your personal data will be permanently erased as described in our Privacy Policy.

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons
  • Discontinuation of the Service

12.3 Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • Your data will be deleted in accordance with our Privacy Policy
  • Sections of these Terms that by their nature should survive termination will remain in effect (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification)

Note: Terminating your account does not automatically cancel your subscription. You must cancel your subscription separately through the App Store or Google Play Store.

13. Modifications to the Service and Terms

13.1 Service Changes

We reserve the right to:

  • Modify, suspend, or discontinue the App (or any part thereof) at any time
  • Change features, functionality, or availability
  • Impose limits on certain features or restrict access to parts of the Service

We will provide reasonable notice of material changes when feasible.

13.2 Terms Updates

We may update these Terms from time to time. When we do:

  • We will update the "Last Updated" date
  • We will notify you through the App or via email
  • Your continued use of the App after changes constitutes acceptance of the updated Terms

If you do not agree to the updated Terms, you must stop using the App and delete your account.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

14.2 Informal Resolution

Before filing a formal claim, you agree to contact us at publisher@webwiz24.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

14.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WebWiz24 regarding the App and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and WebWiz24 as a result of these Terms or your use of the App.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet service failures.

17. Acknowledgment

BY USING EXCUSE AI, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
